Construction site without permit
Minstroy suggests allowing some types of works before the issuance of all documents.
Developers may use the time that is spent for formalization of allowance documentation to prepare the construction site. The changes into Construction Code that are formed by Minstroy includes new concept “preparation works”that will be allowed before the issuance of construction permit. According to experts new mechanism will allow the reduction of construction terms. It will also help to improve the positions in World Bank Doing Business ranking.
Construction companies will be allowed to begin works before the issuance of permits. Changes into Construction Code are prepared by Minstroy. New concept of “preparation works” is included into it. Such works may be started before the issuance of construction permit. It will help developers to reduce the terms of construction and repairs of the facility. It will give the extra period for contractor’s choice.
Extra permit for preparation works will be required. Project documentation should be provided to state expertise (maximum term for this procedure is 20 days)
If construction permit would not be issued during the year the contractor should return the land plot to “the conditions suitable for use” and restore “the conditions of nature”.
Minstroy did not provide express comment.
The lawyer of law department of HEADS Consulting Konstantin Khanin explained that preparation works include The construction of transportation network, the preparation of main engineering networks, the creation of construction infrastructure including the temporary facilities, guardrail and lighting of the construction site, smoking areas, areas for warehouse of building materials the installation of tower crane
According to him the new order will speed up the construction site.
“The time before issuance of construction permit will be spent of “preparation works”. Construction companies will get the advantages of it and speed up the construction” – supposes Khanin
General Director of Expert engineering company Sergey Dolgikov supposes that it will lead to time saving.
“Mobilization and preparation works may take from 3-4 months depending on type of works. It is a serious time period. This time may be used to plan everything, conduct the expertise and prepare all works”, – told he.
Sergey Dolgnikov stressed out that extra time will lead to careful choice of contractor that will lead to the improvement of quality.
“ There will be no rush because the time that is spent to all alignments may be used to do something useful”, – pointed out Sergey Dolgnikov.
He also mentioned that the year that is given for construction permit issuance in new legislation is enough if the developer has required competences.
He also stressed out that the practice of such norms may lead to surprises.
“The idea is good, but there are questions to its realization. Everything depends on the ease of construction permit receiving. If this procedure is difficult then it is more or less the same that we have now” – told Sergey Dolgnikov.
In World Bank Doing Business ranking 2016 Russia took 115th place in category “construction permit”, 40th place in “doing business ease” and 26th in category “ease of company creation”. First Vice Prime minister of Russia Igor Shuvalov stressed it out during the final board of Minstroy in March.
