The authorities intend to simplify the procedure for connecting to communications
Joining engineering networks today is one of the main problems in the work of developers, as well as in the construction of facilities for the city order. Today, from the construction readiness of the facility to connecting all networks and putting the house into operation can take up to a year and a half. In the light of the launched renovation program, such a delay is unacceptable. Last week, a round table was held in Moscow where representatives of the Ministry of Construction and Housing and Communal Services, the Moscow construction complex, developers and network organizations discussed the possible drastic reduction in the terms of technological connection.
“Joining to networks is one of the most important topics in the work of developers regardless of the sources of financing for the constructed facilities. Three years ago, when the volume of real estate in Moscow approached 9 million square meters per year, the problem of technical connection has come to the fore, “- said the head of the Department of Urban Development Policy Sergei Levkin. According to him, from the construction readiness of the facility to the connection of all networks today can pass up to a year and a half.
The cost of technical connection to engineering networks in 2017 grew for developers by 20-30%, while no contract with natural monopolies is being fulfilled on time, said the head of the Moscow Investors Association, Lyubov Tsvetkova. In addition to the growth in the cost of technical connection of developers, it is disturbing that no contract with natural monopolies is being fulfilled on time. “Nobody is responsible for this, while construction companies are punished very severely for non-compliance with the agreements”, she said.
As the Deputy Head of the Electricity Regulatory Authority of the Federal Antimonopoly Service Alexei Voronin noted, Moscow needs to adopt a single legal act that would completely regulate the connection to the networks from the beginning of the application, as well as the pricing procedure. According to him, today more than 80% of violations of grid companies are related to the timing of connection to communications. During the period 2016-2017, about 900 such violations were identified. And according to Deputy Minister of Construction and Housing Hamit Mavliyarov, over the past years, 38 procedures have been excluded in connection with the construction of facilities under construction for engineering networks. If earlier the terms of registration of land relations for the construction of utility networks could be up to 1 year, now the permit for land use is issued within 10 days.
However, experts note that a large number of problematic issues related to the technological connection procedure are being preserved. About 50% of the procedures in the exhaustive list, approved at the federal level, concern the connections to the networks. Problems in technological connection are associated with the lack of synchronization in the construction of connected networks and the main facility, as well as the long terms of the procedures for placing networks by the resource provider.
The current legislation provides for the same procedure for the construction of the facility and the communications connected to it. At the same time, technological connection agreements are concluded at the design stage of the main facility, when the land and town planning documentation for the main facility have already been completed, and the network organization has yet to conduct such procedures for placing the networks, as well as conducting competitive procedures for design. As a result, the terms of connection of communications to the already constructed object are delayed up to one and a half years.
In addition, the role of Rostechnadzor in the process of technological connection is not completely determined today: its powers largely overlap with the powers of state construction supervision agencies and the duties of grid companies, which creates unnecessary administrative barriers.
To address these issues, the Russian government submitted to the State Duma a draft federal law that provides for the possibility of establishing a public easement for the construction of engineering networks. Its design is proposed to be implemented in a simplified manner, said Sergei Levkin. In his opinion, this initiative will simplify the procedure for placing all types of engineering networks.
In early November this year, the government of the country adopted a resolution to conduct a pilot project in Moscow, the Moscow region and St. Petersburg to transfer the services of grid companies to the electronic form. According to Levkin, now work is under way to prepare and conclude agreements between the Moscow government and network organizations that will establish the procedure for interaction when connecting the constructed buildings to networks, as well as the regulations necessary to translate procedures into electronic format. In addition, network organizations are planned to be included in the system of interagency cooperation, which significantly shortens the time for the provision of services and excludes the need to collect the same documents when drafting an application for connection.
However, according to Sergey Levkin, it will take a lot of time to refine the departmental information systems to include network organizations in inter-agency electronic interaction. “The work is not easy, but we must together come to the results that I would like to see at least at the end of 2018, and better next autumn”, he explained.
