Amendments are made into town-planning and land codes.


The Federation Council approved a law introducing significant amendments to the Urban Development Code of the Russian Federation and certain legislative acts. The new document concerns the activities of Glavgosexpertiza in a significant degree and should help optimize the procedures conducted by the Office and their cost.

Changes in the Town Planning Code will differentiate the concepts of “capital construction object” and “non-capital structure”, the second concept will finally give a clear definition.

It also clarifies the powers of the Russian Federation in the field of organizing and conducting state expertise of project documentation and the results of engineering surveys. In addition, innovations are aimed at optimizing the requirements for the composition and content of sections of project documentation.

The new document eliminates the need to prepare project documentation for overhauling capital construction projects (with the exception of repairing at the expense of budget funds). The subject of examination of the project documentation, established by part 5 of Article 49 of the Code, was also changed. In addition, a mandatory examination of project documentation prepared for the overhaul of public roads has been canceled.

The Ministry of Construction of Russia is vested with the authority to approve the classifier of capital construction objects according to their purpose and functional and technological characteristics with a view to maintaining a single state register of expert project documentation opinions. The composition of documents and information to be included in a single register is specified.

Amendments have been made to the Land Code of Russia. In particular, it was supplemented by the chapter “Zones with special conditions for the use of the territory” and provisions regulating the specifics of compensation for damages in case of restriction of rights in connection with the establishment or change of zones with special conditions for the use of territories.
