Elena Povetkina: issuance of documents on conformity of constructed object to technical specifications to be regulated by year-end


Today about 60% of procedures relate to technological connection to engineering networks that is at least one third of financial expenses and time consumption. Therefore each grid company needs a clear and detailed regulation of all procedures in the framework of technological connection ranging from conclusion of agreement to resource provision.

The Head of the office for optimization and control over procedures related to urban planning policy of Moscow Department of Urban Planning Policy Elena Povetkina told correspondent of the portal “Stroim Prosto” about the work on upgrading regulations, its advantages and convenience for developers and grid companies.

Elena Leonidovna, let us speak about the regulations of issuance of documents on conformity of a constructed object to technical specifications which is performed by grid companies?  Who conducts this work and what is the purpose?

In accordance with the City Planning Code in order to obtain an occupancy permit a developer must attach the document certifying the conformity of the constructed object to technical specifications of a grid company. The Codex doesn’t specify the type of the document and its exact title because it refers to legislation on technological connection to different kinds of networks.

In its turn this legislation provides for a number of documents issued by grid companies at the final stage of technical connection. Moreover, a list of documents, their content and issuing procedure are distinguished for different types of networks (electricity, gas, heating, water supply). But this legislation says nothing about the document to be submitted for obtaining an occupancy permit. Thus, the matter is at the junction of two legislations. And the main goal of aforesaid regulations is to resolve the matter of the issuance of these documents.

Each grid company determines in the regulations, what document according to the legislation on grid connection must be issued for of compliance of the constructed object to technical specifications. The elaboration and approval of these documents were launched by the Department of Urban Planning Policy of Moscow.

This work is being carried out since 2015 together with the Department of Housing Maintenance, Utilities and Urban Amenities, and the Department for Fuel and Energy Economy of Moscow, Moscow Mosgosstroynadzor (State Construction Supervision Committee) and grid organizations.

What is the fundamental difference of the process in accordance with the new regulations?

Before the approving of regulations in order to confirm compliance of the constructed object to technical specifications developers had submitted different documents on the same type of networks to Mosgosstroynadzor. Some developers brought “certificates” not envisaged by current legislation.

Now the regulations of each grid company clearly define the title of the document which must be issued by it for confirmation of compliance of the constructed object to technical specifications. Grid companies, developers and Mosgosstroynadzor clearly understand the document in question. Mosgosstroynadzor doesn’t accept any other documents. That is the main thing.

A developer clearly understands from the regulations what division of the grid company he must contact, what are the specific documents he must submit to it in order to obtain a document on conformity and at what time he will obtain this document. Therefore the principal difference consists in the degree of certainty and predictability of the process for all participating parties.

How many grid organizations operate in Moscow?

There are 7 organizations. These are unitary enterprise Mosvodostok (Moscow drain sewerage plant), JSC Mosvodokanal (Moscow Water and Sewage Company), unitary enterprise of Moscow region Mosoblgaz, OJSC MUEC(Moscow United Energy Company), JSC UEC (United Energy Company), OJSC MUEGC(Moscow United Power Grid Company), OJSC Mosgaz.

Which organizations have already received the new regulations? When the work will be finally complete?

The regulations of Mosvodostok, Mosvodokanal, Mosoblgaz, MUEC have been approved during 2015 and the first half of 2016.

Now the approval of draft regulations for UEC, MUEGC, Mosgaz is on the way. All the works are scheduled for completion until the end of the year. Currently we are working very closely on electricity. As soon as we finish this work we will proceed with Mosgaz.

How do these regulations make the life easier for developers and grid companies?

The organizational expenses of developers and time consuming are reduced. The detailed regulation of the procedure of issuance of documents on conformity of constructed objects to technical specifications performed by grid companies allowed to achieve clarity, transparency and a clear understanding of necessary actions algorithm.

Regulations identify an accurate list of executive documentation to be submitted to the grid company by developers in order to obtain these documents.

Grid companies, in turn, made it easier to organize their work. An elaboration of the regulations for some companies worked in the old-fashioned way, stimulated to figure out their business processes and to initiate their optimization.

Was the opinion of developers taken into account during elaboration of the regulations? Were the meetings convened?

Certainly. It was quite a scrupulous work which required a number of meetings and sessions with grid companies, developers, experts. We conducted a mailout of projects, made analysis of received remarks, and held meetings with representatives of the Association of Moscow investors. The representatives of the Agency for Strategic Initiatives were also engaged in elaboration of the regulations. The colleagues assisted us a lot especially in the work concerning MUEC.

What has been changed in the legislation regulating the technological connection in the recent years?

In order to connect to the engineering networks a developer now concludes an agreement of connection (technological connection) which determines legal, financial and technical specifications of connection to appropriate type of the networks.

Implementation of construction and installation works with respect to utility networks, processing of all executive documentation, verifying of technical specifications fulfillment and issuance of acts confirming the completion of technological connection are carried out in the framework of agreement and according to the federal sectoral legislation.

All the procedures related to conclusion and fulfillment of agreements of capital construction object’s connection to utility networks is included in an exhaustive list of procedures in the house construction. It was approved by the resolution of the Russian Federation Government on 30th of April, 2014, № 403. Since the beginning of 2016 the administrative responsibility is provided up to disqualification for the conduction of procedures and issuance of documents not required by the legislation.

All the listed changes entailed the necessity of formalization of the technological connection’s final stage when the implementation of technical specifications is being verified.

Today much emphasis is on transferring the services of grid organizations on technological connection to e-format. When do you plan to introduce it?

It is an extensive and complicated process which has already been launched. Since the beginning of this year you can submit an e-request to Mosvodokanal on obtaining technical specifications and conclusion the agreement for connection to water supply and sewage networks on the state services portal.  You can also submit an e-request to UEC for technological connection to power networks with a capacity up to 150kW.

Now the similar work with MUEGC is in progress.

We suppose the services of all grid companies should be transferred to e-format. Moreover, the whole interaction must be available in e-format, starting with the stage of conclusion an agreement and ending with its closure the way it is already implemented in administrative procedures of  construction sector.

In a perfect world it must look like this:

–  submission of  application on conclusion an agreement,

– a draft agreement appears in the personal account of developer on the state services Portal,

– a developer signs the agreement via e-signature and sends it to a grid company,

– electronically signed agreement of technological connection appears in the personal account,

– further we proceed to interaction on the documents concerning the process of technological connection via the Portal or the personal account of developer.

An important part of this work is connection of grid companies to the interagency e-interaction system. As a result of this reform the necessity to submit to grid companies any documents available to government authorities must be excluded for developers. These documents are extracts from state registry and cadastre, lease agreements, GPZU (development plan of land plot) and others. The necessity to submit to the government authorities the following documents – documents of grid companies, the same documents on conformity of a constructed object to the technical specifications of grid companies should also be obviated. All this document flow must take place bypassing a developer. This system works successfully in the sphere of state and municipal services.

Generally in order to transfer to e-format all the services we need maximally formalized structure of the whole process. And one of the essential stages on this way is the approval of the regulations mentioned in the beginning of our conversation. If the regulations are approved, so the appropriate procedure is almost ready to be transferred to e-format.

Is the elaboration of unified documents for all grid companies possible in prospect?

The technological connection process has its own unique features for each type of utility system. It is very difficult to talk about the full unity and uniformity of technological connection. However the preparation work in this sphere is also conducted by our Department in collaboration with other Moscow government authorities under the leadership of the Ministry of Construction, Housing and Utilities of the Russian Federation and the Ministry of Economic Development and Trade. In our opinion it is really achievable for now   to combine applications for connection to all networks necessary for certain construction project into a united application which will be submitted via the state services Portal. While processing such application will be divided into several applications submitted to different grid organizations by means of information system and will initiate the conclusion of the appropriate agreements of technological connection with each company. We obtained the experience of unifying several applications into one in the framework of including technical specifications on water supply and sewage system to the GPZU (development plan of land plot).
